A Fort Myers, Fla., court postponed the arraignment of Carl Stanley McGee, the openly gay assistant secretary for policy and planning in Gov. Deval Patrick's administration, from Feb. 25 to March 10. McGee was arrested Dec. 28 on suspicion of sexually assaulting a 15-year-old boy in Boca Grande. Samantha Syoen, spokeswoman for the Office of the State Attorney for the Twelfth Judicial Circuit in Florida said the office has not yet decided whether it will press charges or what they would be.

"The reason his arraignment was continued was because we are still reviewing the case and have not yet made our filing decision," said Syoen.
Charles Rankin, McGee's attorney, did not return a call to comment for this story.

McGee, one of the first and highest ranking openly gay officials in the Patrick administration, is currently on unpaid leave.

Police with the Lee County Sheriff's office arrested McGee after receiving a call from a man at a hotel in Boca Grande reporting that his 15-year-old son had been sexually assaulted. According to the police report, the alleged victim told police that McGee approached him in the hotel steam room, masturbated in front of him, and then forcibly performed oral sex on him. McGee was still at the hotel spa when police arrived, and they arrested him.

Prior to joining the administration, McGee served as director of MassEquality's business and civic initiative, which recruited some of the state's top names in business to talk publicly about their support for marriage equality.
